Zito, Assistant County Administrator <br />Subject: Approval of License Agreement for Beach Town Music Festival <br />With Basis Entertainment <br />DESCRIPTION: <br />On March 15, 2016, the Board of County Commission approved a Template License Agreement and Policy <br />Manual for events at the Indian River County Fairgrounds. Beachtown, LLC, is a domestic limited liability <br />company organized under the laws of the State of Iowa and a wholly owned subsidiary of Basis Marketing, <br />Inc., dba Basis Entertainment (the "Applicant"). <br />The Applicant proposes to conduct a two day concert to be known as the "Beach Town Music Festival" on <br />the weekend of October 7-8, 2016, at the Fairgrounds (the "Event') featuring country music star Jake Owen <br />and other recording artists. The Event will be open to the public on Friday October 7`' from 5:00 pm to <br />11:00pm, and Saturday October 8`h from 1 pm to 1 I pm. Although the Event dates are within the 30 day <br />exclusivity period for the previously approved Rocktoberfest event scheduled for October 21-23, 2016, the <br />Applicant has secured a waiver from Fully Involved Event Productions, LLC, permitting the Event. The <br />proposed License Agreement requires Board approval pursuant to Section 205.08 of the Indian River <br />County Code of Ordinances. It should also be noted that some of the material terms for the Event License <br />Agreement require amendments to the approved template following a protracted negotiation process that <br />was facilitated by County Staff. The proposed License Agreement is attached and summarized below: <br />SUMMARY OF AGREEMENT <br />• 2 day music festival seeking Fairgrounds Use Permit and Alcohol Permit <br />o Concert, stage, ticketed sales for admission <br />o Vendor sales <br />o Alcohol sales <br />o Amusement rides <br />o On-site parking <br />o No on-site primitive camping will be offered to the public.
