Assistant County Attorney Terry O'Brien explained that this <br />has been preempted and probably should have been removed several <br />years ago when they changed the law on the issuance of firearm <br />permits. <br />Chairman Eggert asked if anyone objected to this going forward <br />with only three Commissioners present. There were none. <br />The Board reviewed the following memo dated 6/11/92: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien - Assistant County Attorney <br />DATE: June 111 1992 <br />RE: PUBLIC HEARING - JULY 14, 1992 - REPEAL OF CHAPTER S. <br />FIREARMS <br />Chapter 8 has been preempted by Section 790.33, Florida Statutes. <br />This section of the Florida Statutes has, in effect, declared Chapter 8 <br />null and void. The repeal, therefore, is more editorial than <br />substantive. <br />REQUEST: <br />Staff recommends approval of the attached proposed ordinance. <br />Chairman Eggert opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. There were none. <br />ON MOTION by Commissioner Bowman, SECONDED by <br />Commissioner Scurlock , the Board unanimously (3-0, <br />Commissioner Bird being absent) adopted. Ordinance <br />92-25, providing for the repeal of Chapter 8, Firearms, <br />of'the Code of Ordinances of Indian River County and <br />declaring same to be null and void and of no effect. <br />39 <br />JUL 141992 <br />
