Board of County Commissioners Meeting Minutes-Final September 20, 2016 <br /> A motion was made by Commissioner Davis, seconded by Commissioner Zorc,to <br /> modify the previous special exception approval perimeter setback condition as <br /> follows: "All enclosed structures shall be set back a minimum of 40'from the north <br /> and east project perimeters,and a minimum of 150'from the west and south project <br /> perimeters except for up to two single-family residences for on-site retreat managers <br /> which shall be set back a minimum of 40'from all project perimeters." The motion <br /> carried by the following vote: <br /> Aye: 5- Chairman Solari, Vice Chairman Flescher, Commissioner Davis, Commissioner <br /> O'Bryan, and Commissioner Zorc <br /> B. PUBLIC DISCUSSION ITEMS <br /> 1. 16-759 Request to Speak from Gifford Economic Development Council on Update <br /> Attachments: Request to Speak <br /> Wanda Scott, 4306 26th Avenue,representing the Gifford Economic <br /> Development Council, gave a brief presentation, voiced areas of concern for the <br /> Gifford community, and inquired about responses to her letters. <br /> County Administrator Jason Brown encouraged Ms. Scott to contact staff when <br /> she has questions or concerns, and relayed that it was not necessary to wait until <br /> the Board of County Commission meetings to obtain information and updates. <br /> 2. 16-777 Request to Speak from Brian Heady Regarding Code Enforcement <br /> Attachments: Request to Speak <br /> Brian Heady spoke about code enforcement practices and violations, and aired <br /> concerns over a code enforcement case(that dealt with sea turtle issues) and a <br /> homeowner being charged for a commercial event. <br /> Attorney Reingold provided the Board with the specifics of the code <br /> enforcement incident and the continuing Order concerning a commercial event <br /> at a private residence. He cautioned the Board to not get involved since the <br /> issue was currently being litigated in Circuit Court. <br /> 3. 16-921 Addition: Request to Speak from Robert Parcells <br /> Robert Parcells, 8 Seagull Avenue,requested the Board to reduce or waive the <br /> interest on the demolition fees for a parcel of land he recently purchased in <br /> Marsh Island. He said he would pay the lien on the property in the amount of <br /> $19,749. <br /> Deputy Attorney William DeBraal provided the details of the foreclosure, lien, <br /> and pay-off value. He encouraged the Board to accept Mr. Parcells' request, <br /> and to direct staff to prepare a Partial Release of Lien. <br /> A motion was made by Commissioner O'Bryan,seconded by Commissioner <br /> Davis,to approve waiving the interest on the demolition fees and accept <br /> Indian River County Florida Page 13 <br />
