• <br />• <br />LAWS OF FLORIDA 2207 <br />will at once become due and payable and said lien subject to fore- <br />closure, which notice shall be given to the property owner in the <br />same manner as the notice hereinbefore provided for the notice of <br />the meeting of the City Council as an equalizing Board to hear com- <br />plaints thereon. <br />Section 76. Each annual instalment wovided for herein of the <br />consolidated and adjusted assessments shall be paid at the time or <br />times specified in an ordinance of the City Council relative thereto, <br />with interest upon all deferred payments, until the entire amount <br />of said assessment has been paid, and upon the failure of any prop- <br />erty owner to pay any annual instalment due, or any part thereof, <br />or any annual interest upon deferred payments, the City Council of <br />the City of Vero Beach shall cause to be brought the necessary legal <br />proceedings by a bill in chancery to enforce payment thereof, with <br />all accrued interest, together with all legal costs incurred, including <br />a reasonable solicitor's fee, to be assessed as a part of the costs; <br />and in the event of default in the payment of any instalment of an <br />assessment or any accrued interest on said assessment, the whole <br />assessment with interest thereon shall immediately become due and <br />payable and subject to foreclosure. In the foreclosure of any spe- <br />cial assessment service of process against unknown or non-resident <br />defendants may be had by publication as now provided by law in <br />other chancery suits. The foreclosure proceedings shall be pros- <br />ecuted to a sale and conveyance of the property involved in said <br />proceedings as now provided by law in suits to foreclose mortgages. <br />Section 77. If at any time during the life of consolidated and <br />adjusted assessments as herein provided all special assessment <br />bonds which were issued to cover the local improvements for which <br />said assessments were made shall have been paid, any balance in <br />the assessment funding account, or' any uncollected assessments, <br />shall be applied to retiring outstanding refunding bonds which <br />were issued in lieu of special assessment bonds maturing and not <br />otherwise paid. <br />Section 78. The City Council of said City is also authorized to <br />release all improvement liens which have been recorded in the office <br />of the Clerk of the Circuit Court of St. Lucie or Indian River <br />Counties at the time of the passage of this Act for the purpose of <br />executing new liens in accordance with the consolidated and ad- <br />justed plan of assessments as provided for by this Act. <br />Section 79. The City Council shall have power by ordinance to <br />prescribe the width, location, grade and materials of which streets <br />and sidewalks shall be constructed. <br />I ad- <br />
