• <br />• <br />• <br />2188 LA\VS OF FLORIDA <br />the trial of all offenses against the laws of the City, and it shall be <br />his duty to see that the ordinances are faithfully executed and the <br />orders of the Council duly observed and enforced. He shall be <br />Judge of the Municipal Court and shall have power by his warrant <br />to have brought before him any person or persons charged with the <br />violation of the ordinances. He shall have power to require the <br />attendance of witnesses for and against the accused; to administer <br />oaths, to take affidavits and to inquire as to the truth of all charges <br />preferred; to decide upon the guilt or innocence of the accused, <br />and to fix by sentence the penalty prescribed by ordinance, and to <br />enforce the same; to pardon and release persons convicted by him, <br />and to have and exercise all the powers incident and usual to the <br />enforcement of his jurisdiction; and he shall also have the power <br />to punish for contempt of Municipal Court to the extent of a fine <br />not exceeding One Hundred Dollars or imprisonment not exceeding <br />thirty days, or both such penalties in his discretion. Provide'l, how- <br />ever, that the City Council, with the written consent of or at the <br />written request of the Mayor, shall have the power to elect by a ma- <br />jority vote, a suitable person who shall preferably be a duly licensed <br />and practicing attorney at law of said City, and who shall also be <br />a qualified elector therein, to be Judge of the Municipal Court of <br />the City of Vero Beach, and when so elected said Judge shall have <br />the same powers and duties as this Act confers upon the Mayor as <br />such Judge, and upon the election of such Judge the authority of <br />the Mayor as such Judge shall cease, except during the absence or <br />sickness of such Municipal Judge, when the Mayor of said City shall <br />be acting Judge of the Municipal Court of .aid City. The City <br />Council shall fix the compensation of such Judge and the term of <br />office of such Judge, when elected as herein provided, shall expire <br />on the date of the term of the office of the incumbent Mayor. <br />Section 20. The City Council shall have authority by ordi- <br />nance to provide for taking cash security for appearance before <br />the Mayor's Court for any person or corporation accused of <br />violating a City ordinance and for the forfeiture thereof in default <br />of such appearance. <br />Section 21. The Mayor shall have power to suspend any officer, <br />except Councilmen, for misconduct in office, or neglect of duty re- <br />porting his action in writing, with reasons therefor, to the next <br />regular meeting of the Council, for its approval or disapproval. <br />Notice of such suspension and the reasons therefor shall be given - <br />in writing to the suspended officer by mailing the same to his <br />last known address, and the said suspended officer shall have <br />
