Brown, County Administrator <br />From: Vincent Burke, P.E., Director of Utility Services <br />Prepared By: Arjuna Weragoda, P.E., Capital Projects Manager <br />Subject: Fischer Lake Island Subdivision Phase 1 through 6 and Replat of 7 Petition Water <br />Assessment Project UCP 4118, Public Hearing and the Adoption of Resolution No. III <br />BACKGROUND <br />On August 16, 2016, the Indian River County Board of County Commissioners (BCC) approved the adoption <br />of Resolution 1(2016-072) and Resolution II (2016-073) for the Fischer Lake Island (FLI) Subdivision Phases 1 <br />through 6 and Replat of 7, located north of CR -512 at the north end of Water Vliet Avenue in Sebastian. Since <br />the adoption of Resolution I and 11, staff mailed out certified letters to the sixty (60) property owners <br />notifying them of the preliminary assessment roll and the subject public hearing. Included in the letter <br />was an invitation to an informal meeting held on September 15, 2016, at the Fischer Lake Island Clubhouse <br />where project details and financing options were discussed. Eight (8) property owners were present at <br />the meeting, including the point of contact, Mr. Richard McCormick. <br />ANALYSIS <br />The FLI Subdivision has 60 parcels benefitting from the water main. The clubhouse tract located at the <br />entrance to the FLI subdivision was excluded from the assessment project. The parcels vary in size. The <br />average parcel size is 0.865 of an acre. Excluding the clubhouse, signed petitions in favor of the project were <br />received from 42 of the 60 residential parcels, or 70.0% of the property owners. The 60 parcels according to <br />tax records are zoned as follows: <br />• 19 Vacant lots <br />• 41 Single Family Residential parcels <br />• 1 Clubhouse tract <br />The BCC, in its capacity to oversee the assessment process, shall meet as the equalizing board to hear and <br />consider any and all support for, or complaints against, the proposed special assessments, and it shall <br />adjust and equalize the special assessments on the basis of justice and right according to Indian River <br />County Ordinance Chapter 206 (Special Assessments). The City of Sebastian was notified August 15, 2016 <br />of the subject proposed water assessment project in accordance with the 1995 Interlocal Agreement. No <br />objections from the City have been received. <br />The cost of the single lateral and the meter box for the clubhouse has been divided amongst the 60 residential <br />parcels. If the clubhouse tract is to be connected to county water, then a separate application for connection <br />by the Fischer Lake Island Home Owners Association will be required. The total project cost is estimated at <br />$486,424.20, which includes construction, surveying, engineering, administration and inspection.
