U <br />establishments anticipated to occur in future years. In order to <br />finance these improvements, several combined methods of financing <br />will be necessary, one of which is an impact fee. <br />The Board of County Commissioners of Indian River <br />County, Florida has the authority under Florida Statutes 5125.01 <br />and 5163.3161 et seq., and supporting cases to establish a user <br />charge hereinafter called an impact fee in order to offset the <br />cost of the necessary extension of the County's water and sewer <br />systems. The amount of these impact fees have been established on <br />the recommendation of the County's rate consultants and after wide <br />ranging input from concerned citizens at public hearings. <br />The Board of County Commissioners now finds and deter- <br />mines after an examination of all methods of financing, that the <br />impact fee is a necessary integral part of financing the cost of <br />future water systems and wastewater treatment systems in the <br />County at this time, and that this fee should be reviewed on a <br />regular basis in order to ensure that it continues to reflect a <br />charge that is commensurate with the burden imposed on the system <br />by new development. <br />A. Impact Fee Imposed. There is hereby imposed an <br />impact fee according to the following schedule, based on the <br />equitable portion of the cost of financing the extension of the <br />County's sewer and water systems on each equivalent residential <br />unit responsible for creating the need for additional system <br />expansion. The obligation to pay the impact fee shall occur at <br />the earliest of the following dates: <br />When the capacity is reserved, when a water or sewer permit <br />is granted, or when a building permit is issued. <br />Water service. . . . . . . . . . . See Appendix "A" <br />Sewer service. . . . . . . . . . . See Appendix "A" <br />B. If a building permit is issued for an existing non- <br />residential, commercial or industrial connection which will <br />increase water demand or sewer treatment demand or if a building <br />changes from residential to non-residential occupancy, the total <br />number of equivalent residential units for the old and new parts <br />of the facility will be computed according to the definition of <br />-11- <br />
