County utility system. The refund agreement shall provide for a <br />plan of refund based upon the connection of other properties, to <br />the extent of their hydraulic share, which properties will be <br />served by the "off-site" facilities installed by the developer. <br />Notwithstanding the provisions of this section, the County will <br />:s <br />limit the life of such refund agreement to a term of not more than <br />five (5) years, after which time any portion of the refund not <br />made to the developer by the terms and conditions of the refund <br />agreement will have lapsed and thereafter such refund agreement <br />shall be canceled. In no event shall the developer recoup an <br />amount greater than the difference between the capitalized cost of <br />such "off-site" improvements and the developer's own hydraulic <br />share of such improvements. The developer shall not be entitled <br />to any interest upon the refund of the developer's advance. <br />SECTION 11 <br />i <br />EXISTING AGREEMENTS <br />County recognizes that certain developer agreements have <br />been executed by the County and developers in the past. Nothing <br />in this ordinance shall be construed to abrogate, obviate or avoid <br />the respective parties obligations in those agreements. <br />SECTION 12 <br />UNIFORM EXTENSION POLICY <br />The Board of County Commissioners of Indian River <br />County hereby declares its intent to adopt a uniform non- <br />discriminatory water and sewer service extension policy. Such <br />policy is hereby authorized to be adopted by resolution of the <br />Board of County Commissioners and provide for but not be limited <br />t <br />to the following subjects: <br />(a) Uniform policy for the extension of the County's <br />water system <br />(b) Uniform policy for the extension of the County's <br />wastewater system <br />(c) Criteria for determining the financial feasibility <br />for such extensions <br />(d) Apportionment of costs for off-site water systems <br />(e) Apportionment of costs for off-site sewage <br />-17- <br />
