The refund agreement shall provide for a plan of refund based upon the connection of other properties, to the extent of their hydraulic share, which properties will be served by the "off-site" facilities installed by the developer. Notwithstanding the provisions of this section, the County will :s limit the life of such refund agreement to a term of not more than five (5) years, after which time any portion of the refund not made to the developer by the terms and conditions of the refund agreement will have lapsed and thereafter such refund agreement shall be canceled. In no event shall the developer recoup an amount greater than the difference between the capitalized cost of such "off-site" improvements and the developer's own hydraulic share of such improvements. The developer shall not be entitled to any interest upon the refund of the developer's advance. SECTION 11 i EXISTING AGREEMENTS County recognizes that certain developer agreements have been executed by the County and developers in the past. Nothing in this ordinance shall be construed to abrogate, obviate or avoid the respective parties obligations in those agreements. SECTION 12 UNIFORM EXTENSION POLICY The Board of County Commissioners of Indian River County hereby declares its intent to adopt a uniform non- discriminatory water and sewer service extension policy. Such policy is hereby authorized to be adopted by resolution of the Board of County Commissioners and provide for but not be limited t to the following subjects: (a) Uniform policy for the extension of the County's water system (b) Uniform policy for the extension of the County's wastewater system (c) Criteria for determining the financial feasibility for such extensions (d) Apportionment of costs for off-site water systems (e) Apportionment of costs for off-site sewage -17-
