t!: <br />1 <br />3 <br />a <br />3 <br />0 <br />A <br />A <br />Alternates may be proposed and will be considered if a price is submitted for the base bid as <br />shown on the bid foam. <br />B-1.4 Modification and Withdrawal of propoos is <br />Proposals may be modified or withdrawn by an appropriate document duly executed (in the <br />manner that a Proposal must be executed) and delivered to the place where Proposals are to be <br />submitted at any time prior to the opening of Proposals. <br />B-1.5 Proposals to Remain Open <br />All Proposals shall remain open for 120 days after the day of the Proposal opening. County shall <br />release Proposals and return Proposal securities as specified in this section under "Return of <br />Proposal Security". <br />B-2 PROPOSAL SECURITY <br />A proposal bond, irrevocable letter of credit, or certified check in the amount of five percent of <br />the estimated annual contract operation price plus the construction cost shall accompany each <br />proposal. In addition, a proposal bond, irrevocable letter of credit or certified check in the <br />amount of five percent of the construction cost shall accompany each proposal. <br />The required security must be in the form of a certified check, cashier's check or a proposal <br />bond. The proposal bond must be executed by a surety meeting the requirements set forth in <br />General Conditions. <br />Bonds or checks shall be made payable, without condition, to Indian River County, Florida. <br />Proposal security will be returned as soon as the successful Proponent has furnished a <br />performance bond or all proposals have been rejected by the County, but not to exceed 120 days <br />after the date of receipt of proposals by the County. <br />If a Proponent withdraws his proposal, fails to negotiate in good faith with the County, or if after <br />the County and the Proponent agree on terms of a contract, the Proponent fails to sign a contract <br />and provide the necessary bonds with 10 days after a copy of the Contract has been presented to <br />him, the amount of deposit shall be forfeited and retained by the County as liquidated damages. <br />B-3. SIGNATURE AND AUTHORITY <br />If the proposal is made by a partnership, the name, address, list of partners, and signature of one <br />of the general partners must be provided; if made by a corporation, the proposal shall indicate the <br />state in which the corporation is chartered, the name and address of the corporation, and <br />certification of the authority of the officer signing the proposal to execute contracts on behalf of <br />the corporation. <br />B-3 <br />DpO917H020.97 <br />
