tt <br />1 <br />a <br />1 <br />1 <br />1 <br />Bid Item No. 2 53.822.100.00 <br />Lump Sum <br />Three million eight hundred twenty-two thousand one hundred dollars and 00/100 cents <br />Written <br />The undersigned Proponent agrees to furnish within 14 days of award of a contract the required <br />Performance Bond, Labor and Material Payment Bond, Power of Attorney, and Certificates of <br />Insurance for both the operations and construction projects. Contractor agrees to complete all <br />contract operations work by December 31, 2002 and to accept an extension of the Operations <br />Contract Time not to exceed five years if requested by the SWDD. <br />The undersigned Proponent hereby certifies (a) that this Proposal is genuine and is not made in <br />the interest of, or in the behalf of, any undisclosed person, fine, or corporation, and is not <br />submitted in conformity with any agreement or rules of any group, association organization, or <br />corporation; (b) that he has not directly or indirectly induced or solicited any other Proponent to <br />put in a false or sham Proposal; (c) that he has not solicited or induced any person, firm or <br />corporation to refrain from submitting a proposal; and (d) that he has not sought by collusion to <br />obtain for himself any advantage over any other Proponent or over the SWDD. <br />The Proponent agrees to provide the services as specified within this Document in accordance <br />with the schedule below: <br />1. Assume operation of the Indian River County Solid Waste Disposal District Class I <br />Landfill within 90 calendar days after award of a contract. Operation will <br />commence on January 1, 1998. <br />The Proponent agrees to provide the services as specified within this Document in accordance <br />with the schedule below: <br />2. Commence the Class I Landfill Infill Construction and Partial Closure Construction <br />within 14 calendar days after award of a contract. Construction will commence on <br />January 1, 1998. <br />ARTICLE lII <br />TERM OF CONTRACT <br />The terms of this operations contract shall be for the period beginning January 1, 1998 and <br />concluding on December 31, 2002, subject to the continuing appropriation of funds by the <br />SWDD for the services to be performed by the terms of this contract. The Contract Time for this <br />contract may be extended for a period not to exceed five years, at the sole option of the SWDD. <br />Indian River County will notify the Contractor nine (9) months in advance of the end of the first 5 <br />year contract of its intent to renew the contract for an additional 5 years and to begin <br />negotiations. <br />A-3 <br />pitea° <br />
