Change Order as used herein shall mean a written order to the Contractor subsequent to <br />the signing of the Agreement authorizing a change in the Agreement. The Change Order <br />shall be signed by the Contractor and the SWDD Director and the SWDD Board of <br />Commissioners. <br />k. Time of Completion as stated in the Contract Documents is to be interpreted as <br />consecutive calendar days measured from the date established in the written Notice to <br />Proceed, or such other date as may be established herein. (Article 22) <br />1. Liquidated Damages as stated in the Contract Documents is an amount reasonably <br />estimated in advance to cover the losses incurred by the County by reason of failure of the <br />Contractor to complete the Work within the time specified. <br />m. Surety, as used herein shall mean the Bonding Company or Corporate Body which is <br />bound with and for the Subcontractor, and which engages to be responsible for the <br />Subcontractor and his acceptable performance of the Work. <br />n. Third Party - An individual or business that is not under the employ or a part of any <br />organization the Contractor has financial interest in. <br />o. Engineer - Shall mean Camp Dresser & McKee Inc., a professional independent <br />engineering firm or any other professional independent engineering firm designated to <br />assist the County in the Work by a separate agreement entered into by the County and <br />said firm. <br />ARTICLE 2 - INTENT AND EXECUTION OF DOCUMENTS <br />a. These Operations Contract Documents and Operations Contract Specifications are <br />complementary, one to the other. The Infill and partial closure Construction Contract <br />Forms and Specifications and plan set are also complementary to each other. The <br />Operations Contract Documents and Specifications are not complementary to the Class I <br />Landfill Infill Segments I and II Construction Contract Documents and Specifications. <br />That which is called for in a section of the Operations Contract Documents, or shown on <br />an Operations Drawing or called for in the Specifications shall be as binding as if it were <br />both called for and shown. The intent of the Operations Contract Documents is to <br />establish the scope of all labor, materials, transportation, equipment, and any and all other <br />things necessary to provide a complete job. In case of discrepancy or disagreement in the <br />Agreement Documents, the order of precedence shall be: Form of Contract, <br />Specifications, Large Scale Detail Drawings, Small Scale Drawings. <br />b. The Contractor shall execute each copy of the Proposal and Contract as follows: <br />1.
