ARTICLE 1 - DEFINITIONS <br />GENERAL CONDITIONS <br />a. The Agreement consists of the General Conditions of the Agreement; Special Conditions; <br />Supplementary General Conditions; the Drawings and Specifications, including all <br />bulletins, addenda, or other modifications of the Drawings and Specifications <br />incorporated into the documents prior to their execution; the proposal; the Agreement; <br />Insurance Certificates; and approval of County Attomey. Articles (1) through (4) apply to <br />both the operation and construction projects. Articles (5) through (36) apply to the - <br />Operations Contract only. <br />The General Conditions, Supplementary Conditions and Specifications which are part of <br />the Contract Forms and Specifications for the Class I Landfill Infill - Segments I and II <br />shall apply to that portion of the Work. <br />b. The Owner is Indian River County. <br />c. The Chairperson is the Chairperson of the Indian River County Board of County <br />Commissioners. <br />d. The Director is the Director for Solid Waste Disposal District of Indian River County or <br />his designated representative. <br />e. The Contractor, as referred to hereinafter, shall be deemed to be the contracting party <br />called the "Party of the First Part" in either of the several contracts in connection with the <br />total project. <br />f. A Subcontractor, as the term is used herein, shall be understood to be one who has <br />entered into a direct contract with the Contractor, and includes one who furnishes <br />materials worked to a special design in accordance with Plans and Specifications covered <br />by the Agreement. Subcontractor shall be directly responsible to the Contractor only. <br />g. Written notice shall be defined as notice in writing, by registered mail to the President of <br />the Corporation or to a company official designated in the contract. <br />h. Work, as used herein as a noun, is intended to include, but not limited to. material, <br />equipment, labor, maintenance and workmanship of the appropriate Contractors. <br />i. County Landfill Supervisor. The County Solid Waste Disposal District Manager shall be <br />the designated individual of the Solid Waste Disposal District Director who shall be <br />responsible for the daily monitoring of the progress and performance of the Work. <br />GC -1 <br />00065610940.97 <br />
