N <br />11 <br />determined as provided for under Article 15(c). <br />ARTICLE 9 - INSPECTION OF THE WORK <br />a. It is a condition of this Agreement that the Work shall be subject to reasonable inspection <br />by the Director, his designated Engineer, and those persons required or authorized by <br />State law to inspect or test special work for official approval. The Contractor shall <br />therefore provide safe access to the Work at all times for such inspections. <br />b. All instructions to the Contractor will be made only by or through the Director or his <br />designated project representative. Observations made by official representatives of the <br />County shall be conveyed to the Director for review and coordination prior to issuance to <br />the Contractor. <br />c. Where special inspection or testing is required by virtue of any State laws, instruction of <br />the Director, specifications or codes, the Contractor shall give adequate notice to the <br />Director or Engineer of the time set for such inspection or test, if the inspection or test <br />will be conducted by a party other than the Director, or his authorized representative, and <br />it shall be the Contractor's responsibility to serve ample notice of such tests. <br />d. All laboratory tests shall be paid by the County unless provided otherwise in the <br />Agreement or construction specifications except the Contractor shall pay for additional <br />laboratory tests to prove compliance with the Agreement where materials have tested <br />deficient except when the testing laboratory did not follow the appropriate ASTM testing <br />procedures. <br />e. Should any work be covered up or concealed prior to inspection and approval by the <br />Director or Engineer, such work shall be uncovered or exposed for inspection, if so <br />requested by the Director or Engineer in writing. Inspection of the Work will be made <br />promptly upon notice from the Contractor. All costs involved in uncovering, repairing, <br />replacing, recovering, and restoring to design condition the Work that has been covered <br />or concealed will be paid by the Contractor. <br />f. If any other portion of the Work has been covered which the Director has not specifically <br />requested to observe prior to being covered, the Director may request to see such work <br />and it shall be uncovered by the Contractor. If such work be found in accordance with the <br />Contract Documents, the cost of uncovering the replacement shall, by appropriate Change <br />Order, be charged to the County. If such work is found to be not in accordance with the <br />Contract Documents the Contractor shall pay such costs unless it is found that this <br />condition was caused by the County as provided in Article 11, in which event the County <br />shall be responsible for the payment of such costs. <br />ARTICLE 10 - CONSTRUCTION SUPERVISION <br />a. Throughout the progress of the Work, each Contractor shall keep on the job a competent <br />superintendent or supervisory staff satisfactory to the Director.
