A <br />(iv) Action of Other Parties. Indemnity shall not be required of the Contractor nor shall <br />the Contractor in any way be liable or responsible for any fines, charges, or penalties <br />against County for any violations unless directly attributable to the actions or omissions <br />of Contractor. <br />(v) Remedial Action. Contractor shall not be liable for remedial actions for past <br />operations necessary to bring the Landfill into proper compliance for action or omissions <br />occurring prior to Contractor's assuming operations and shall not be responsible for <br />major capital expenditures such as ponds, wells, etc., necessary for remedial action. <br />d. Comparative Negligence. In the event any claim, loss, liability or damage is caused by or <br />attributable to the negligent act or omission of both Contractor and another party, the laws <br />of comparative negligence of the State of Florida shall be applicable. <br />ARTICLE 34 - TAXES <br />a. Fecieral Taxes: The County is exempt from Federal Excise Taxes and Transportation <br />Taxes. The County will issue exemption certificates only upon request of Contractor. <br />All requests for tax refunds are to be handled by the Contractor. The County will not <br />guarantee any Federal Tax refunds to the Contractor. <br />b. State Taxes: The County is exempt from Florida Sales and Use taxes on direct purchases. <br />All Contractor direct purchases should include sales and use tax and shall be included in <br />the Contractor's cost. <br />ARTICLE 35 - EQUAL OPPORTUNITY CLAUSE <br />The Contractor shall abide by all applicable laws, ordinances, or regulations regarding <br />discrimination against any protected person or class of persons. <br />ARTICLE 36 - ADDITIONAL GENERAL CONDITIONS <br />a. Delivery of Waste. The Contractor shall accept, all Class I solid waste less identified and <br />separately collected recyclables, created within the jurisdiction of County or for which <br />County has accepted responsibility provided such waste may lawfully be disposed of in <br />an environmentally sound manner. The Contractor undertakes no responsibility for the <br />collection or delivery of waste to be disposed of at the landfills. <br />b. Scope of Service. The Contractor shall have the right to operate the Class I landfill in a <br />manner to best achieve operating efficiencies, including such techniques as relocation of <br />roads and the sequencing of space utilization within each major disposal cell. Contractor <br />shall effectively optimize the use of Class I airspace. The Contractor shall provide all <br />required daily services in operating the Class I landfills including all required covering <br />operations of the permit as set forth in the operation plans. <br />GC -19 <br />bpoesmoo-30 97 <br />
