SECTION 1.04 - PREVENTION, CONTROL, AND ABATEMENT OF EROSION AND <br /> WATER POLLUTION <br /> The work specified in this item shall conform to Section 104 of the Florida Department of ' <br /> Transportation Standard Specifications for Road and Bridge Construction with the following <br /> modifications. <br /> PART 1 — GENERAL <br /> 1.1 SCOPE <br /> A. This Section covers erosion control and the treatment of dewatering water and <br /> stormwater runoff from the construction site and work area. Pollution control measures <br /> shall prevent polluted or turbid waters from being discharged from the construction site <br /> or work area to undeveloped portions of the site or offsite, including but not limited to <br /> Multiple Separate Storm Sewer Systems (MS4s) and Waters of the State. <br /> B. The OWNER considers pollution from dewatering water and stormwater runoff from a <br /> construction site or work area to be a very serious offense. The CONTRACTOR is <br /> solely responsible for preventing pollution caused by dewatering water and stormwater <br /> runoff from the construction site or work area. Note that state regulations do not allow <br /> mixing stormwater and dewatering groundwater in the same release — separate and <br /> independent discharges are required. <br /> C. Pollution control measures specified herein represent minimum standards to be <br /> adhered to by the CONTRACTOR throughout the Project's construction. The OWNER <br /> reserves the right to require the CONTRACTOR to employ additional pollution control <br /> measures, when in the sole opinion of the OWNER, they are warranted. If site specific <br /> conditions require additional erosion and stormwater pollution control measures during <br /> any phase of construction or operation to prevent erosion or to control sediment or <br /> other pollution, beyond those specified in the Drawings, the Project's approved <br /> Stormwater Pollution Prevention Plan (SWPPP), or herein, implement additional best <br /> management practices as necessary, in accordance with Chapter 4, "Best <br /> Management Practices for Erosion and Sedimentation Control" of the Florida Erosion <br /> and Sediment Control Inspector's Manual and other references as may be applicable <br /> or required by regulatory permits. <br /> D. The OWNER may terminate this Contract if the CONTRACTOR fails to comply with <br /> this Section. Alternatively, the OWNER may halt the CONTRACTOR's operations until <br /> the CONTRACTOR is in full compliance with this Section. If the OWNER halts the <br /> CONTRACTOR's Work as a result of failure to comply with this Section, the Contract <br /> time clock will continue to run. <br /> E.
