8/1/91 i(legal)RESO/Vk /43 9 <br />RESOLUTION NO. 91- 94 <br />A RESOLUTION OF INDIAN RIVER COUNTY, <br />FLORIDA, CALLING FOR A SPECIAL ELECTION TO <br />EXPAND THE BOUNDARIES OF THE INDIAN RIVER <br />MOSQUITO CONTROL DISTRICT TO INCLUDE <br />FELLSMERE, VERO LAKE ESTATES, AND <br />ADJACENT PROPERTIES AND TO AUTHORIZE THE <br />DISTRICT TO IMPOSE AN AD VALOREM TAX OF <br />NOT -TO -EXCEED TEN MILLS ON SUCH NEWLY <br />INCLUDED PROPERTY. <br />WHEREAS, the Indian River Mosquito Control District (hereinafter <br />DISTRICT) has recommended to the County that the City of Fellsmere, the <br />unincorporated area known as Vero Lake Estates, and adjacent properties <br />be incorporated within the DISTRICT boundaries to provide mosquito control <br />services within those areas; and <br />WHEREAS, pursuant Section 388.211, Florida Statutes, the Board of <br />Commissioners of the DISTRICT may request the Board of County <br />Commissioners in each county to change the boundaries of the DISTRICT; <br />and <br />WHEREAS, Indian River County has approved such boundary change by <br />Resolution No. 90-99, adopted on September 4, 1990, and to expand the <br />DISTRICT's boundaries to include the area described in Resolution No. <br />90-99; and <br />WHEREAS, by Chapter 91-337, Laws of Florida, the Legislature <br />confirmed the addition of Fellsmere, Vero Lake Estates, and adjacent areas, <br />as described in Resolution No. 90-99, into the DISTRICT boundaries subject <br />to a referendum of the qualified electors in the area to be included; and <br />WHEREAS, Florida law requires that before any special district can <br />impose an ad valorem tax that there be a referendum approving such levy; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AT THE REQUEST <br />OF THE BOARD OF COMMISSIONERS OF THE INDIAN RIVER MOSQUITO <br />CONTROL DISTRICT, that: <br />1. A special election be called within the territory to be added to the <br />DISTRICT, i.e., as described in Resolution No. 90-99, to be held on <br />November 5, 1991, at which the following question will be presented to <br />the voters: <br />
