CONSENT AGENDA: 4/18/17 78 <br />Office of <br />INDIAN RIVER COUNTY <br />ATTORNEY <br />Dylan Reingold, County Attorney <br />William K DeBraal, Deputy County Attorney <br />Kate Pingolt Cotner, Assistant County Attorney <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold — County Attorney <br />DATE: April 7, 2017 <br />SUBJECT: Resolution Authorizing the Submittal of an Application to FDEP <br />Requesting an Easement for Utilities on State Owned Uplands under <br />Lease by Indian River County <br />With regard to temporary Fire Station #15 at the North County Regional Park, the <br />County, as the utility service provider, will require a utility easement for the water line <br />servicing the modular structure. Since Indian River County manages the property under <br />Lease Agreement No. 4490 and Sublease No. 4490-1, With the Board of Trustees of the <br />Internal Improvement Trust Fund, an Application for the Use of State Owned Uplands is <br />required to be submitted; and a formal resolution of the Board of County Commissioners <br />requesting such an easement must accompany the application. <br />Presented herewith for consideration and adoption is a resolution authorizing the <br />submittal of an application to FDEP requesting a utility easement for the water line. <br />FUNDING: <br />There is no cost associated with the application. <br />RECOMMENDATION: <br />Adopt the resolution, and authorize the Chairman to execute same for submitting with the <br />application request to the Florida Department of Environmental Protection. <br />nhm <br />attachments: Resolution <br />Application <br />P15 <br />
