Keat g, A' <br />Community Developmer& Director <br />THROUGH: Stan Boling, AICP <br />Planning Director <br />FROM: Eric Blad ,07 X a SI <br />Staff Planner, Current Development <br />DATE: September 4, 1992 <br />SUBJECT: Living Lord Lutheran's Request for Major Site Plan and <br />Special Exception Approval for a Place of Worship <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of September 15, 1992. <br />DESCRIPTION AND CONDITIONS: <br />Mr. James W. Young, P.E. has submitted an application for a major <br />site plan and special exception approval on behalf of Living Lord <br />Lutheran Church to construct a place of worship at 2725 58th <br />Avenue. The proposed place of worship provides seating for 107 <br />people, a fellowship hall, and related offices. The proposed use <br />is located within a RS -3 zoning district, which requires special <br />exception use for a place of worship. The applicant has verified <br />that no child care or school is proposed in relation to the church. <br />Any future proposals for such uses would require special exception <br />use approval. <br />The Planning and Zoning Commission unanimously granted approval for <br />the site plan on August 27, 1992, subject to the Board of County <br />Commissioners granting special exception approval and subject to <br />certain conditions recommended by staff. The Planning and Zoning <br />Commission also unanimously recommended that the Board of County <br />Commissioners grant special exception use approval for a place of <br />worship. The Board of County Commissioners must now take final <br />action on the special exception request for a place of worship. <br />If the Board grants special exception approval, the site plan <br />conditional approval will become effective. <br />Special exception uses are those types of uses that would not <br />generally be appropriate throughout a particular zoning district. <br />However, when special exception uses are carefully controlled as to <br />number, area, location, and/or relationship to the vicinity, such <br />uses would not adversely impact the public health, safety, comfort, <br />good order, appearance, convenience, morals and general welfare and <br />as such would be compatible with permitted uses within the <br />particular zoning district. In granting any special exception, the <br />Board may prescribe appropriate special conditions and safeguards <br />to ensure that the use is compatible with surrounding uses in the <br />district. <br />ANALYSIS: <br />1.
