The Board of County Commissioners <br />subsequently granted special exception and conceptual PRD plan <br />approval for the entire project (all phases) on August 21, 1990. <br />Therefore, the effective date of the preliminary PRD plan approval <br />is August 21, 1990,with an original expiration date of August 21, <br />1991. <br />Prior to the August 21, 1991 expiration date.0the applicant's agent <br />requested a 12 month extension of the PRD approval, which the Board <br />of County Commissioners granted making the new expiration date <br />August 21, 1992. Prior to the August 21, 1992 expiration date,the <br />applicant's agent indicated to staff that the applicant would not <br />be able to commence construction prior to August 21, 1992 due to <br />financial and permitting constraints and requested that the Board <br />modify its previous extension time from 12 months to 18 months. <br />Preliminary PRD approvals may be extended for up to 18 months from <br />the initial approval date, under the regulations in effect at the <br />time of the Coquina approval. The Board is now to consider <br />modifying the previously granted Coquina phase I preliminary PRD <br />plan extension. <br />ANALYSIS: <br />In planning staff's opinion, the Board of County Commissioners has <br />the ability to modify the previously granted 12 month extension <br />since an extension of up to 18 months was allowed by the PRD <br />provisions under which the Coquina project was reviewed and <br />approved. The developer is now close to obtaining a county land <br />development permit which will enable project construction to <br />commence. Thus, Board action to modify the previous extension will <br />allow the land development permit to be issued and the project to <br />go -forward. <br />Although the Coquina project was reviewed and approved under the <br />old LDRs, the requirements of the adopted comprehensive plan were <br />in effect at the time of project review and were applied. During <br />its evaluation of the previous request for a 12 month extension, <br />staff concluded that there were no changes in the LDRs which would <br />result in a substantial change to the project's design. This same <br />conclusion now applies to the request to modify the extension to <br />cover an 18 month period rather than a 12 month period. <br />RECOMMNDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners grant the applicant's request to modify the <br />period of time covered by the approval extension from 12 months to <br />18 months. The new expiration date of the phase I preliminary PRD <br />plan approval is February 21, 1993. The plan approval is subject <br />to all original approval conditions and applicable Chapter 910 <br />concurrency requirements. <br />4 <br />
