Board of County Commissioners <br />Meeting Minutes - Final June 20, 2017 <br />13.D. 17-0647 <br />Recommended Action: <br />She gave details on the funding for Visit Florida; and the creation of a new program <br />called the Florida Job Growth Grant Fund. <br />No Action Taken or Required <br />Florida Department of Environmental Protection Domestic Wastewater <br />Facility Permit for Sunbreak Farms <br />The County Attorney's Office recommends that the Chair allow for public comment <br />on this matter and then have the Board vote whether to authorize the County <br />Attorney's Office to move to intervene in the St. Lucie County petition. <br />Attachments: Staff Report <br />Notice of Intent to Issue Permit <br />Letter from Stan Boling to Toby Overdorf, dated June 9, 2017 <br />Letter from Jason Brown to Florida Department of Environmental <br />Protection, dated June 12, 2017 <br />St. Lucie County Petition for Administrative Hearings <br />Memorandum from Jill Grimaldi, to Katherine Barbieri, dated Mav 16, <br />2017 <br />County Attorney Dylan Reingold provided information on the intent of the Florida <br />Department of Environmental Protection (FDEP) to issue a permit for a Domestic <br />Wastewater Facility for Sunbreak Farms, LLC located in Indian River County and <br />St. Lucie County. He stated that the County did not file a petition for an <br />administrative hearing to challenge the permit, but instead met with representatives <br />from Sunbreak Farms, LLC to discuss the proposed facility. He stated that the <br />County drafted and sent a letter to FDEP expressing concerns with regard to what <br />the County felt as lenient reporting criteria and issues with the stormwater holding <br />capacity of the facility. He noted that St. Lucie County filed a petition for <br />administrative hearing challenging the permit, and requested direction from the <br />Board as to whether to intervene with St. Lucie County's filing of the petition for <br />administrative hearing to challenge the intent to issue a permit for the construction <br />of a Type I Biosolids Management Facility. <br />Commissioner Solari inquired as to whether there was any benefit for the County to <br />intervene, and felt that it was not necessary to take the additional legal step to <br />intervene with St. Lucie County in the filing of their petition. <br />Vice Chairman O'Bryan made comments regarding the Special Call meeting that he <br />attended in St. Lucie County, where he observed that the majority of the speakers <br />were concerned that there had not been enough time to fully analyze the issues. He <br />expressed concern over some of the wording in the documents involved with the <br />permit and stated that he was in favor of intervening with St. Lucie County as a <br />show of support and to ensure that all the questions are answered. <br />Indian River County Florida <br />Page 23 <br />
