Where the Applicant requires usage after the stipulated time, Applicant is required to pay additional charges including, but not limited to standard hourly/daily rates and any overage fees as set forth in the Fairgrounds Fee Schedule attached as Exhibit B ("Fee Schedule"). B. AUTHORIZED USE, TERMS & CONDITIONS: 1. The Premises are to be used by Applicant for the Vero Beach Antique Extravaganza (the "Event"), a vendor based public antique show. (a) The Event may include the following activities: i. Approx. 100 merchandise vendors. ii. 4-5 food vendors iii. Entry fee for the public from $8-$15 depending on the day. iv. Parking fee (b) The hours of the Event shall be: Friday, January 26, 2018, 12-5pm; Saturday, January 27, 2018, 9am-5pm; and Sunday, January 28, 2018, 9am-4pm. i. Applicant may have access to the Open Air Expo Pavilion and the 6-10 acres for the License Duration. (c) Applicant may have access to the Expo Building for a total of 36 hours. Any hourly overages in use shall be rectified during the post event reconciliation. The facility is considered occupied from the time the building is opened until it is locked each day. (d) Load in hours shall begin on Thursday, January 25, 2018, at 7am. Tear down and load out shall be from 4pm-11:59pm on Sunday, January 28, 2017. (e) The Event shall be used for no other purpose whatsoever, unless prior written approval is requested in writing by Applicant and given by the County which approval shall be subject to availability but not be unreasonably withheld, conditioned, or delayed so long as such request is submitted at least 90 days prior to the beginning of the License Duration. Such change may result in a modification of the insurance requirements set forth in B. 17. 2. The Applicant shall have first right of refusal for January 25-27, 2019, and will have 30 calendar days from the last day of the previous year's event to provide a security deposit, which shall be a minimum of 25% of the Fairgrounds License Agreement Fees Schedule in effect at that time to the County to secure the subsequent year's date. If the Applicant fails to provide the security deposit as described in this section, the Applicant forfeits the reservation of the future date under this License Agreement. 3. Applicant agrees to pay to the County as rent, costs, expenses and taxes for the use of the Premises the following sums: (a) Rental fee will be $9,276.90 plus any additional charges imposed at the request of the Applicant to be reconciled at the end of License Duration, based on the calculations on the attached Fee Schedule. A minimum of TWENTY-FIVE percent (25+%) of the entire rental fee, $2,640.23 ("Event Deposit") was paid on August 24, 2017. The balance of the rental fee set forth above and any remaining payments, including any expenses, charges or other fees described in this License Agreement shall be due thirty (30) days prior to the Event.
