Rison <br />Senior Planner, Current Development <br />DATE: October 6, 1992 <br />SUBJECT: Extension of Contract for Construction of Required <br />Sidewalk Improvements Colonial Gardens Subdivision, Unit <br />1 - SD -90-08-011 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of October 13, 1991. <br />DESCRIPTION AND CONDITIONS: <br />�. On March 15, 1992, the Board of County Commissioners granted final <br />plat approval for the Colonial— Gardens Subdivision, Unit 1. <br />Pursuant to Land Development Regulations Section 913.09(5)(D), the <br />developer, Vero Building Corporation, and the county executed a <br />Contract for Construction of Required Sidewalk Improvements to <br />guarantee the future installation of the sidewalks required within <br />the subdivision. To guarantee the contract, the developer also <br />provided a letter of credit. At this time, over 508 of the <br />subdivision's sidewalks have been completed. The developer is now <br />.requesting to extend the completion date of the original contract <br />and to reduce the posted security amount to reflect the reduced <br />amount of remaining sidewalk work. <br />ANALYSIS: <br />The construction of subdivision sidewalks on a delayed basis is <br />permitted in LDR Section 913.09(5)(D). This section allows for a <br />delay of up to four (4) years in order to accommodate the <br />construction of homes within a subdivision. The proposed contract <br />modification for the Colonial Gardens Subdivision, Unit 1, would <br />extend the original contract to provide a period of two (2) years <br />to complete the subdivision's sidewalks. The developer has <br />executed the contract modification agreement and has provided <br />security in an amount sufficient to guarantee the remaining work. <br />County staff, including the County Attorney's Office, have reviewed <br />the submitted modification agreement and security and have no <br />objection to the request. <br />4 <br />
