Ke t g AIC <br />Community Developmentirector <br />I-p <br />FROM: Roland DeBlois; AICP <br />Chief, Environmental Planning <br />& Code Enforcement Section <br />DATE: October 13, 1992 <br />SUBJECT: Unlicensed Contractor Citation Ordinance <br />Implementation Procedures Manual <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of October 20,'1992. <br />DESCRIPTION & CONDITIONS <br />On April 21, 1992, the Board of County Commissioners adopted <br />Ordinance 92-09, creating unlicensed contractor citation procedures <br />(as well as general code enforcement citation procedures). <br />At that time, in order to ensure consistency and reasonableness in <br />citation enforcement, the Board directed staff to develop specific <br />implementation guidelines and report back to the Board before the <br />ordinance is used as an enforcement means. <br />A staff procedures manual for unlicensed contractor citation <br />enforcement has now been drafted. For this reason, staff requests <br />Board consideration and authorization to implement the unlicensed <br />contractor citation procedures of Ordinance 92-09. <br />ALTERNATIVES AND ANALYSIS <br />Ordinance 92-09 consists of two main parts: general citation <br />procedures and contracting citation procedures. These two <br />procedures differ based on Florida statute requirements. At this <br />time, staff'have adopted implementation guidelines for contractor <br />citations only; additional guidelines for general code enforcement <br />citations will be forthcoming at a'later date. <br />Contracting Citation Procedures ' <br />The citation procedures section of Ordinance 92-09 was adopted in <br />accordance with Section 489.127, F.S. Different from general <br />citation procedures, no prior notification is required for <br />citations relating to unlicensed contractors. Another major <br />difference is that a contested contracting citation is heard by <br />the Code Enforcement Board rather than by county court. A Code <br />Board decision, however, could subsequently be appealed to circuit <br />court. <br />The staff procedures manual consists of six "programs", outlining <br />steps under the following categories: <br />1. Complaint unfounded procedure <br />2. Penalty paid procedure. <br />3. Penalty not paid procedure <br />4. Appearance before the Code Enforcement Board <br />5. Appellate review . <br />6. Unlicensed contractor citation training program. <br />20 <br />
