F, DEC 8 1,997 <br />BOOK 8O Pk 'IF 226 <br />MOTION WAS MADE by Commissioner Bird, SECONDED by <br />Commissioner Macht to use the 150 -foot rule on Mr. <br />Carlson's piece of property. <br />Under discussion, Attorney Vitunac stressed that the <br />definition of the 150 -foot rule should be changed if it is used in <br />this manner. <br />Chairman Eggert recommended that it should depend on the <br />situation and whether or not the property is touching a road. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />The Motion was voted on and carried unanimously. <br />Russell Peterson, local attorney, asked the Board to combine <br />his five -acre and his one-half acre parcels and apply the 150 -foot <br />rule to the entire 318 feet of frontage. <br />Commissioner Bird expressed a willingness to apply the 150 - <br />foot rule and reduce the assessment to two acres. <br />Commissioner Macht pointed out that treating two parcels as <br />one is an exception to the rule. <br />Discussion ensued, and Mr. Peterson stressed that he was <br />willing to unify the two parcels but explained that the deadline <br />has passed for filing a unification request. He mentioned that <br />portions of the property are not buildable because there is a muck <br />pond on the land. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Adams, the Board unanimously agreed to <br />combine the five -acre parcel and the .57 acre parcel <br />and apply the two -acre rule, subject to Mr. Peterson <br />filing the proper unity of title. <br />Jim Beindorf, Jr., 4780 2nd Street, stated that he owns 2.62 <br />acres, was assessed $10,329.81, and would like to know if there was <br />any way that amount could be reduced. <br />Commissioner Bird conveyed that the Board would need some <br />unique circumstances to justify an adjustment. He realized that <br />Mr. Beindorf has a deed restriction on his property, but the County <br />Attorney has advised that private deed restrictions are not <br />enforceable by the County. <br />Chairman Eggert asked, and Attorney Vitunac confirmed, that <br />limiting the lot to one house does not change the total square <br />footage being assessed. <br />18 <br />
