Davis, P.E., <br />Public Works Director <br />SUBJECT: Request for County to Grade Unpaved Roads <br />with the Following Right -of -Ways <br />1) 101st Court between 90th Street and 92nd <br />Street in Vero Lakes Estates Subdivision <br />(.25 mile) - <br />2) 79th Street between 102nd Court and <br />102nd Avenue in Vero Lakes Estates <br />Subdivision (.1 mile) <br />3) 82nd Street east of U.S. 1 (.15 mile) <br />DATE: December 9, 1992 <br />DESCRIPTION AND CONDITIONS <br />The Public Works Department has received requests for the <br />County to assume road grading within the above subject <br />right-of-ways from property owners along the right-of-ways. <br />Since 1981, the County has not assumed the grading of <br />additional unpaved roads unless authorized by the Board of <br />County Commissioners after consideration of the results of a <br />numerical evaluation procedure adopted in 1981. In the <br />early 1980's, the County Attorney issued an opinion that the <br />County did not have an obligation to grade roads within <br />dedicated right-of-ways if those roads were not being <br />graded. The entire issue of maintenance of dedicated <br />ungraded right-of-ways in the County was discussed during <br />the March 5, 1991 and May 7, 1991 Board of County <br />Commissioners meeting (minutes attached).
