PD PLAN ANALYSIS: <br />BOOK 88 NAu. 60 3, <br />The PD plans indicate that two separate department stores, a Wal- <br />Mart (126,249 square feet) and a Sam's (134,900 square feet), are <br />proposed on the subject site as part of Phase I project <br />construction. An additional 31,973 square foot and 26,656 square <br />foot expansion of the Wal-Mart and Sam's stores respectively, is <br />proposed for Phase II project construction. <br />1. Size of Development Area: 32._58 acres <br />Florida Statutes governing developments of regional impact <br />(D.R.I.$) presume that a commercial development proposal is a <br />DRI if the project area involves more than 40 acres of land. <br />If the project is from 80% - 1008 of the threshold (32 to 40 <br />acres), then the project is presumed not to be a, DRI. <br />Although. the county's DRI requirements (Chapter 916) give the <br />Board of County Commissioners the authority to require either <br />a clearance letter or a binding letter of interpretation from <br />the Department of Community Affairs (DCA) for projects over <br />the 80% threshold, staff does not recommend that the Board of <br />County Commissioners require either letter in this case. <br />Though neither county staff nor the Treasure Coast Regional <br />Planning Council has requested a DRI -related letter, DCA has <br />required that the applicant obtain a clearance letter from the <br />DCA. The applicant and county staff have worked with DCA <br />staff for several months in order to allow the DCA sufficient <br />time to issue a clearance letter. As of the writing of this <br />report, no clearance letter has yet been issued. County staff <br />contacts with DCA staff indicate that a clearance letter <br />should be issued in the near future. <br />2.
