JAN 19 1993 <br />RESOLUTION NO. 93- 17 <br />A RESOLUTION OF INDIAN RIVER COUNTY, <br />FLORIDA, TO THE SECRETARY OF THE <br />FLORIDA DEPARTMENT OF ENVIRONMENTAL <br />REGULATION REGARDING DELEGATION OF <br />CERTAIN UTILITY PERMITTING AUTHORITY <br />UNDER SECTION 403.18151 FLORIDA <br />STATUTES. <br />BOOK 88 N. H617-1 <br />WHEREAS, Section 403.1815, Florida Statutes, allows the Florida <br />Department of Environmental Regulation (FDER), upon request, to allow any <br />county to independently regulate the construction of water distribution mains <br />of 12 -inches or less, gravity sewage collection systems of 12 -inches or less, <br />and sewage force mains of 12 -inches or less, and pump stations appurtenant <br />to such force mains, provided that the plant is owned by the county making <br />the request; <br />WHEREAS, in considering such request the FDER shall determine the <br />administrative- and engineering ability of the county to administer and comply <br />with the requirements of Section 403.1815 , F . S . ; and <br />WHEREAS, Indian River County believes that its Department of Utility <br />Services is qualified to administer and comply with the aforementioned <br />requirements; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />1. The Secretary of the FDER is respectfully requested to consider <br />delegating the permitting requirements under Section 403.1815, F.S. , <br />for the utility facilities authorized in the referenced section. <br />2. An invitation is extended to the Secretary of the FDER to visit Indian <br />River County and be shown the utility facility and the staff operations <br />of the Department of Utility Services. The County agrees to sponsor <br />this trip, since the County believes that the information to be learned <br />from a visit by the Secretary will convince the FDER that the County is <br />amply qualified to undertake its own permitting. <br />48 <br />
