The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />Cornelius Hargis, 935 34th Avenue, came before the Board and <br />stated that she did not want the water. <br />Commissioner Tippin conveyed that in every area of the county, <br />there is somebody who does not want the water. He asked Mr. <br />Vitunac to discuss this. <br />Attorney Vitunac advised that individuals are not required to <br />accept the water but are legally required to pay for the cost of <br />the line going past their property because it improves the value of <br />property. <br />Mrs. Hargis felt that the County has no right to come onto her <br />private property to install the water lines. <br />Mr. Vitunac explained that the County had to redesign the <br />project because property owners in her subdivision refused to give <br />the necessary right-of-way, which resulted in a 14.5 percent cost <br />increase. <br />Utility Services Director Terry Pinto commented that the water <br />lines will be placed along the rear lot lines, where the County has <br />a dedicated utility easement. <br />It was determined that no one else wished to be heard and the <br />Chairman closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously (4-0, <br />Commissioner Bird being absent) affirmed the <br />preliminary assessment on the subject project and <br />accepted the maintenance of the 10 -foot rear lot <br />line easements where the water lines will be <br />installed, as recommended by staff. <br />AFTER THIS MEETING WAS HELD, IT WAS DISCOVERED THAT THE ABOVE <br />PUBLIC HEARING HAD BEEN ADVERTISED FOR MARCH 9, 1993 INSTEAD OF <br />MARCH 2, 1993. IT WAS DECIDED THAT IT WOULD BE PUT BACK ON THE <br />AGENDA FOR NEXT WEEK"S BCC MEETING, THE PUBLIC HEARING WOULD AGAIN <br />BE OPENED FOR PUBLIC COMMENT, AND THE RESOLUTION WOULD THEN BE <br />PASSED. <br />25 <br />MAR m 1991 BOOK NVUE 953 <br />
