ANALYSIS: <br />The required improvements have been completed by the developer, and <br />a certificate of completion has been issued by the Public Works <br />Department. A warranty and maintenance agreement and bond are not <br />required, since the only publicly dedicated improvements are <br />utilities which have been warranted separately. The developer has <br />complied with the appropriate requirements to obtain final plat <br />approval. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant final <br />plat approval for Harbor Villages Phase I. <br />TO: BOARD OF COUNTY COMMISSIONERS <br />FROM: Charles P. Vitunac, County Attorney <br />DATE: March 9, 1993 <br />RE: GRAND HARBOR PLAT 12 CONSTRUCTION <br />ASSIGNMENT OF WARRANTY TO COUNTY <br />The Development Order for Grand Harbor required that certain utility <br />improvements be constructed. The sub -subcontractor has issued a <br />maintenance bond in favor of the subcontractor, which is now assigning <br />the maintenance bond to the County. The attached agreement is this <br />Assignment and requires the signature of the Chairman to accept it on <br />behalf of the Board. <br />If for some reason the Assignment fails and there is warranty work to be <br />performed, the subcontractor has agreed to enforce the maintenance bond <br />according to its terms. <br />REQUESTED ACTION: The Board authorize the Chairman to execute the <br />attached Assignment. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously granted <br />final plat approval for Harbor Villages Phase I and <br />authorized the Chairman to execute the assignment of <br />rights, as recommended by staff. <br />ASSIGNMENT IS ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />5 <br />�I�AROOK 89 P,11;F 09 <br />� � X993 <br />
