L—A <br />ORDINANCE 93- 9 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA AMENDING SECTION 100.05, INDIAN <br />RIVER COUNTY CODE TO MAKE THE GENERAL <br />PENALTY PROVISIONS APPLICABLE TO <br />ORDINANCES PRIOR TO CODIFICATION. <br />WHEREAS, the general penalty provisions in section 100.05 <br />specifically apply to code violations; and <br />WHEREAS, a strict interpretation of said section could be that the <br />penalty provisions do not apply to a county ordinance until it appears <br />In the code; and <br />WHEREAS, it is desirable to remove this ambiguity and have the <br />penalty provisions apply to any ordinance upon becoming law, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. AMENDMENT. <br />Section <br />100.05. General <br />penalty; <br />continuing violations is amended <br />by adding a <br />new paragraph 4 <br />to read <br />as follows <br />4. The provisions of this section shall apply to any ordinance of <br />Indian River County when it has become law just as if this section were <br />In the ordinance. <br />SECTION 2. SEVERABILITY. <br />If any section, or if any sentence, paragraph, phrase, or word of <br />this ordinance is for any reason held to be unconstitutional, in- <br />operative, or void, such holding shall not affect the remaining portions <br />of this ordinance, and it shall be construed to have been the legislative <br />intent to pass the ordinance without such unconstitutional, invalid or <br />Inoperative part. <br />SECTION 3. EFFECTIVE DATE. <br />This ordinance shall become effective upon becoming law. <br />Approved and adopted by the Board of County Commissioners of <br />Indian River County, Florida, on this _n day of March , 1993. <br />W <br />BOOK F,1GE� <br />
