APP - 6 1993 <br />BOOK 89 PA'U'E <br />intent criteria, serves a necessary buffer function, provides a <br />logical transition from commercial to residential uses, and <br />provides a termination point for non-residential uses on this part <br />of 43rd Avenue. <br />Specific Requirements of the PRO District <br />According to the County's Land Development Regulations, the <br />specific requirements for PRO districts located in an area with a <br />residential land use designation are: <br />• the district must be located on an arterial or collector road; <br />• the district must have a_maximum depth of 300 feet; and <br />• the district must have a minimum size of five acres and a <br />maximum size of 25 acres. However, the district may be <br />reduced to 2.5 acres if it meets the following criteria: <br />• The parcel abuts a commercial node; and <br />• The parcel is located in a substantially developed area; <br />and <br />• The parcel is located in an area dominated by <br />nonresidential uses. <br />Staff has determined that the subject property meets these <br />criteria. While the property is less than five acres in size, it <br />is larger than -2.5 acres, is located adjacent to the S.R. 60/58th <br />Avenue node, is located in a substantially developed area, and is <br />located in an area dominated by non-residential uses. <br />Conclusion <br />It is staff's position that the request to rezone the subject <br />Property to PRO is consistent with the comprehensive plan and the <br />land development regulations, meets all concurrency requirements, <br />will not negatively impact environmental quality, and is compatible <br />with the surrounding area. Staff also feels that rezoning the <br />subject property will encourage infill development and a more <br />efficient use of land and public facilities. For these reasons, <br />staff supports the request. <br />Recommendation <br />Based on its analysis, staff recommends that the Board of County <br />Commissioners approve this request to rezone the subject property <br />from RS -3 to PRO. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />32 <br />
