Cain, P.E. ! <br />County Engineer <br />SUBJECT: CR512 Electric Utility Reloc 'on <br />DATE: May 3, 1993 <br />D <br />DESCRIPTION AND CONDITION <br />In order to construct the improvements to CR 512, it will be necessary to relocate an FPL <br />transmission pole and facilities located within an easement held by FPL over the Right of Way of <br />CR 512 and predating the existence of the Right of Way. It will be necessary in this case to pay FPL <br />to relocate their facilities at this location. FPL estimates the cost of this relocation will be $41,844. <br />A letter from FPL is attached for verification. FPL indicates the Board of County Commissioners <br />must indicate its agreement to pay the relocation expense before it will move the facilities. The <br />Board may do : this by -authorizing the Chairman to execute the attached form letterprovided by FPL <br />for this purpose. <br />Alternative No. 1, authorize the Chairman to execute the letter agreement, and when the Chairman <br />has signed it.,return it to the Engineering Department for handling. <br />Alternative No. 2, do not authorize the Chairman to execute the letter agreement. <br />RECOhOdENDAMON AND El MIDING <br />Staffrecommends Alternative No. 1., with funding to come from Account No. 101-153-541-06738, <br />the project account for the County Road 512 improvement project. <br />Chairman Bird asked, and Attorney Vitunac confirmed, that in <br />this instance the County is responsible for payment of costs <br />associated with relocating the utility because the utility easement <br />was in existence before the County acquired the right—of—way. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously approved <br />Alternative No. 1, payment of expenses to relocate a <br />Florida Power & Light transmission pole and <br />facilities at a total estimated cost of $41,844.00, <br />as set forth in staff's recommendation. <br />COPY OF LETTER OF AGREEMENT WITH FLORIDA POWER & LIGHT, <br />IS ON FILE IN THE OFFICE OF CLERK TO THE BOARD <br />55 <br />SAY i��g BOOK 89 FACH 5 00 <br />I <br />
