Reati g, AVP <br />Community Development Director <br />Ift <br />THROUGH: Stan Boling, AICP <br />Planning Director <br />FROM: Eric Blad� <br />Staff Plani er, Current Development <br />DATE: May 10, 1993 <br />SUBJECT: Richard Fey's Request for Special Exception Use Approval <br />and Conceptual Site Plan Approval for a Private Land <br />Clearing Debris Burning Facility <br />[SP-MI-93-06-014/IRC #93030069-002] <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of May 18, 1993. <br />DESCRIPTION AND CONDITIONS: <br />Richard Fey, d/b/a L.I. Tree Service, Inc., represented by Peter W. <br />Jones, P.A., has submitted an application for conceptual site plan <br />and special exception use approval for a private land clearing <br />debris burning facility. The subject site is located approximately <br />1/2 mile southwest of the City of Fellsmere on CR 512 and abuts the <br />Park Lateral Canal to the east. The subject property is located <br />within an A-2 zoning district, a district which requires special <br />exception use approval for a land clearing debris burning facility. <br />The proposed plan for the facility is conceptual in nature, and its <br />approval will not constitute approval for construction. If this <br />special exception use and conceptual site plan approval request is <br />granted, a subsequent site plan for construction must be submitted <br />and approved prior to actual site development. <br />At its regular meeting of April 22, 1993, the Planning and Zoning <br />Commission voted 3-2 to recommend that the Board of County <br />Commissioners grant the special exception use and conceptual site <br />plan approval request. The county code, however, requires that at <br />least 4 members of the 7 member Planning and Zoning Commission vote <br />in favor of a motion for that motion to be approved. Because the <br />referenced motion passed with only three favorable votes, no <br />official recommendation from the Planning and Zoning Commission can <br />be forwarded to the Board. Pursuant to the county's special <br />exception procedures, this request is to be heard by the Board of <br />County Commissioners without an official recommendation from the <br />Planning and Zoning Commission. <br />The Board of County Commissioners is now to consider the request <br />and approve, approve with conditions, or deny the special 'exception <br />use application. Pursuant to section 971.05 of the LDRs, the Board <br />of County Commissioners is to determine whether the use is <br />appropriate for the subject property and surrounding area. Based <br />upon this determination, the Board may grant approval and attach <br />any conditions and safeguards deemed appropriate to mitigate <br />27 <br />
