Recti , A <br />THRU: Sasan Rohani • R <br />Chief, Long -Range Planning <br />FROM: John Wachtel8�' <br />Staff Planner, Long -Range Planning <br />DATE: May 15, 1993 <br />RE: Trevor Smith and others Request to Amend -the <br />Comprehensive Plan and to Redesignate Approximately 1.86 <br />Acres from L-2 to C/I, and to Rezone from RS -6 to CL <br />(LURA 92-07-0160) _ <br />It is requested that the data- herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of May 25, 1993. <br />DESCRIPTION AND CONDITIONS <br />This is a request to. amend the Comprehensive Plan and rezone <br />approximately 1.86 acres. Located on the west side of Old Dixie <br />Highway between -8th Street and 9th Street, the subject property <br />consists of six parcels, each separately owned. .The owners are <br />Trevor Smith, Phyllis Smith, Robert W. Wood, Beth Wood, Michael <br />Jaholkowski, Ruby L. Albritton, and Susan L. Thomas. <br />The request involves changing the land use designation from L-2, <br />Low -Density Residential (up to 6 units/acre) to C/I, Commercial/ <br />Industrial Node, and rezoning the property from RS -6, Single -Family <br />Residential District (up to 6 units/acre) to CL, Limited Commercial <br />District. The purpose of this request is to secure the necessary <br />land use designation and zoning to develop the property with <br />commercial uses. <br />In January, 1991, Trevor Smith, the owner of the northern -most <br />parcel of the subject property, applied to have his parcel's land <br />use designation changed to C/I. After consideration of this <br />request, the -Planning and Zoning Commission voted 4-2 to recommend <br />that the Board of County Commissioners deny the request. On May <br />21, 1991, the Board unanimously followed that recommendation and <br />denied transmittal of the request to the Department of Community <br />Affairs. Subsequent to that denial, Mr. Smith joined with several <br />of his neighbors, and they jointly submitted the comprehensive plan <br />amendment request presently under consideration. <br />With respect to the present request, the Planning and Zoning <br />Commission, on October 22, 1992, voted 3-2 to recommend that the <br />Board of County Commissioners transmit the proposed land use <br />amendment to the state Department of Community Affairs (DCA) for <br />their review. Although a majority of Planning and Zoning <br />Commissioners present voted in favor of the amendment request, <br />Section 103.02.12 of the County Code of Laws and Ordinances states <br />that any matter or application considered by a board or commission <br />with more than five members must receive four or more votes for <br />passage.
