JUN <br />BOOK 89 <br />F, -1 <br />FAU'. 843 <br />FLEET MANAGEMENT <br />UNDERGROUND FUEL STORAGE TANKS STATE <br />REI14BURSEMENT AGREEMENT <br />Public Works Director Jim Davis presented the following memo <br />dated June 7, 1993: <br />TO: James E. Chandler, <br />County Administrator <br />FROM: James W. Davis, P.E., <br />Public Works Director <br />SUBJECT: Fleet Management UndergrOund Fuel Storage Tanks - <br />State Reimbursement Agreement <br />REF. LETTER: Adam J. Darrow, TransAmerican Environmental, Inc. <br />to Jim Davis dated April 28, 1993 <br />DATE: June 7, 1993 FILE: tanks.agn <br />DESCRIPTION AND CONDITIONS <br />TransAmerican Environmental, Inc. (TEI), Consultant for the Fleet <br />Management Division's Underground Fuel Tank Abandonment program and <br />Clean America Financial Corp.(CAFC), are offering the County a <br />program whereby TEI will perform all work required by the State DER <br />to clean up the Fleet Management tank arear including -consulting <br />fees, petroleum product contamination assessment, petroleum product <br />remediation, etc., and CAFC will bill the Florida DER directly, <br />without the County having to fund the work, submit numerous <br />reimbursement documentation, and directly compensate TEI. Since <br />this site had been determined to be eligible for state <br />reimbursement, the County can apply for cost reimbursement. TEI <br />and CAFC will assume all risk in receiving reimbursement for <br />petroleum product contamination under this program, and will accept <br />whatever payment FDER approves. There is a one time*fee of $2500 <br />for this service, which covers a due diligence study of the site to <br />ensure eligibility. To date, the County has expended <br />approximately, $39,000, much of which should be reimbursed by the <br />State. <br />TEI has requested that the County execute the Contract first. TEI <br />will forward the executed contract to their financial backer CAFC <br />for approval. Af ter the Contract has been signed by CAFC, one <br />fully executed contract will be returned to the County. <br />ALTERNATIVES AND ANALYSIS <br />Staff has reviewed the State reimbursement procedures and <br />reimbursement forms and have found them to be quite lengthy (18 <br />pages). In addition, it has been reported that payment <br />reimbursement may take up to 18 months. Staff time preparing <br />consultant contracts, agenda items, DER liaison, etc. is time <br />consuming.
