I f. you <br />V <br />will not represent us, who will? <br />-1 implore-you,'do not, as the Very Beach City Council has-Aone, <br />put a price on the health, 'safety, and I I fe of my child. <br />Thank you, <br />Bonnie Rohant <br />Commissioner Eggert advised that the Board expressed extreme <br />concern about this matter in the letter that was sent to the City <br />Council. <br />County Attorney Charles Vitunac advised that a 1992 revision <br />to Section 403.61 of Florida Statutes, subparagraph 30, states that <br />the Department of Environmental Regulation (DER) has preempted the <br />field of protection of people from electromagnetic radiation to the <br />point that any county or city ordinances to the contrary are not <br />valid. Apparently, this is a state-wide problem and the State does <br />not want to have communities coming up with answers that may affect <br />the state-wide distribution of electricity. The only powers we <br />have are the powers to reasonably protect public health and safety <br />when we give permission to use County right-of-way; that would be <br />any reasonable condition except those having to do with <br />electromagnetic radiation. He advised that Attorney Collins has a <br />copy of the DER I s rules and regulations and would be happy to share <br />them with the petitioners. However, there is no vehicle for the <br />County to do anything other than write letters suggesting that, the <br />City of Vero Beach and the DER do something. <br />15 <br />Bou 89 uu 971 <br />
