AU6 10 1993 BOOK 90 Pad 16 <br />PENDING ORDINANCE DOCTRINE <br />The Board reviewed the following memo dated August 2, 1993: <br />To: Board of County Commission <br />From: Commissioner Carolyn K. Eggert eKf <br />Date: August 2, 1993 <br />Subject: Pending Ordinance Doctrine <br />You may recall the Board of County Commission meeting when <br />we decided to send on additional criteria for the <br />resort -residential ordinance for consideration as a LDR. At that <br />time, I attempted to invoke the pending ordinance doctrine by <br />making a motion for a moratorium on all applications requiring <br />resort -residential special exceptions. That motion failed for <br />- lack of a second. Remarks were made that a four month time span <br />before LDR hearings was too long. <br />The LDR hearings begin on August 23. I have received many <br />calls asking that we take no further action on resort -residential <br />requests until our final LDR hearing on September 7 is over, a <br />period of one month. People are especially upset about the <br />prospect of current, partially -developed subdivisions being <br />changed into resorts. <br />I request that the Commission join me in reconsidering and <br />approving a moratorium on resort -residential, based on the <br />pending ordinance doctrine, until our September 7 LDR hearing is <br />over. <br />Commissioner Eggert decided to bring this matter up again <br />because of recent court rulings restricting Commissioners from <br />receiving or engaging in communication outside Board meetings <br />regarding certain planning and development matters. She indicated <br />that it is difficult to explain to people that she cannot discuss <br />these subjects with them, and she felt that it might help if we put <br />a moratorium on these applications until after the public hearing <br />on LDRs is over. This will enable us to tell people that nothing <br />is going to happen until we finish the public hearings and it would <br />give them some comfort. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Macht to put a moratorium on all new <br />applications for special - exception use for <br />residential resorts until after the September 7th <br />LDR hearing. <br />Under discussion, Chairman Bird stated he wanted to ascertain <br />that this would not jeopardize the pending Disney resort. <br />38 <br />
