M ® M <br />AIR QUALITY STUDY - CLAYTON ENVIRONMENTAL SERVICES <br />The Board .reviewed the following memos dated 8/11/93: <br />TO: James Chandler, County Administrator <br />TBRU: Jack Price, Personnel DirectorX� <br />FROM: Beth Jordan, Risk Manager <br />DATE: 11 August 1993 <br />SUBJECT: Contract for Services; Clayton Environmental Consultants <br />Attached, for Board consideration and as a follow up to Board <br />direction on August 3, 1993, please find a proposed contract with <br />Clayton Environmental Consultants for an indoor air quality <br />evaluation of the Utilities/Solid Waste Disposal District offices <br />in the County Administration Building. <br />In addition to the contract, we have also obtained resumes of the <br />individuals who will participate in the evaluation as well as <br />information on the independent laboratory which they will use for <br />testing. That information is also attached. <br />The County Attorney's Office has suggested the following changes, <br />which are being considered by Clayton's contracts officer. Mr. <br />Griffin, our liaison, has indicated verbally that there should be <br />no problem with making the changes which are: <br />11. Strike indemnification language by County such that <br />the final sentence of the first paragraph reads: "Client waives <br />any claim against Clayton except to the extent such loss results <br />from Clayton's negligence." Continuing onto the next page, the <br />first sentence will read: "In the event that any of Clayton's <br />activities hereunder are at Client's site, Client will assume sole <br />and complete responsibility for the project site, including safety <br />of all persons and property except to the extent such liability <br />arises from the negligence of Clayton." <br />113. (b) Change first sentence to read: "Fees shall be <br />paid pursuant to the Florida Prompt Payment Act, F.S. 218.70." <br />Strike second sentence in its entirety. <br />13.(c) Change number of days to "thirty (30)." <br />13.(d) In first sentence, delete reference to thirty <br />(30) days and replace with "the time allowed by F.S. 218.70." <br />18. and 19.
