63 1093 <br />r- SEP <br />BOOK . g Ph - 91 -I <br />Paragraph 8 and Exhibit A require the FCT and FCT Applicant (Indian <br />River County) to agree to enter into and comply with a <br />Confidentiality Agreement relating to appraisals, offers and other <br />negotiation matters. This Confidentiality Agreement is to be signed <br />by each member of the Board of County Commissioners and any staff <br />member potentially involved in the purchase negotiation. <br />Paragraphs 22 and 23 provide that the County will contract for and <br />pay for all of the cost and expenses associated with title, <br />appraisal maps, appraisal reports, and surveys, with the FCT <br />reimbursing cost -share funds only if a closing occurs. <br />Advantages/Disadvantages <br />The advantage of the County taking the responsibility of <br />negotiating the purchase of the Wabasso Scrub site is expediency. <br />Although the FCT is willing to undertake negotiations and other <br />aspects of acquiring the property, the FCT has limited staff that <br />are involved with numerous projects throughout the state. <br />Indications from other applicants and land acquisition <br />organizations are that a property is more likely to be successfully <br />acquired if negotiated by the applicant. This particularly applies <br />to the Wabasso Scrub site, because the property is under one <br />ownership, and property appraisal characteristics are <br />uncomplicated. <br />The major advantage of having the FCT take responsibility for <br />acquisition of the Wabasso Scrub property is that -the necessary <br />acquisition activities would not infringe on county staff time <br />devoted to other tasks. Moreover, acquisition of the property by <br />the FCT would relieve the County from any accusations that the <br />County did not negotiate the best deal for public acquisition. <br />In that the Wabasso Scrub site has uncomplicated physical and <br />ownership characteristics, and in that the FCT cost -share amount <br />has already been substantially determined, it is staff's position <br />that the advantage of County negotiations outweighs the benefits of <br />the FCT taking responsibility for negotiations. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners authorize <br />the Board Chairman to execute the attached Multi -Party Acquisition <br />Agreement with the Florida Communities Trust regarding acquisition <br />of the Wabasso Scrub site. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously approved <br />and authorized the Chairman to execute the Multi - <br />Party Acquisition Agreement with the Florida <br />Communities Trust regarding acquisition of the <br />Wabasso Scrub site, as recommended by staff. <br />PAI3Y EXECUTED COPY OF AGREEMENT <br />IS ON FILE IN THE OFFICE OF CLERK TO THE BOARD <br />54 <br />
