M <br />Indian River County needs an additional 30 feet of right-of-way for <br />the petition -paving project on 33rd Street. The Board of County <br />Commissioners previously approved the purchase of the right-of-way <br />along this corridor on January 21, 1992. These are the last three <br />parcels to be acquired. <br />The owners have each executed a Contract For Sale And Purchase near <br />the appraised value without cash compensation at this time - but <br />with no petition paving assessment after the road is constructed. <br />The County Attorney has reviewed each contract with no objection to <br />the contract language. <br />Additionally, each contract contains stipulations to relocate trees <br />and guarantee their survivability for one year, and pay for six <br />other trees at a total cost not to exceed $600.00 if the trees have <br />to be removed from the additional right-of-way. <br />The county is to obtain title insurance and correct any defect of <br />title at the county's expense, which is a condition on all three <br />contracts. <br />The following is the appraised value and assessment cost for each <br />parcel: <br />George & Sharon Glenn <br />Helen Glenn <br />Steven & Frances Sherwood <br />June, 1991 <br />AMraiised Value <br />$1,080.00 <br />$1,350.00 <br />$1.983.56 <br />Right-of-way Total value = $4,413.56 <br />Assessment Total and Contract Amount o <br />Assessment <br />$ 324.49 <br />$6,860.69 <br />$ 440.38 <br />$7,625.56 <br />Staff has discussed Eminent Domain proceedings with the County <br />Attorney's office. The final cost of condemnation to acquire the <br />three parcels would be far in excess of the contracts. Staff <br />requests the Board accept the three contracts, approve the $750 <br />attorney fee and direct the Chairman to execute the contracts on <br />the Board's behalf. <br />Public Works Director Jim Davis explained that some of the <br />difference in the values is due to Helen Glenn having more acreage <br />than her children. <br />Commissioner Eggert asked why the 1991 appraisal is lower, and <br />Director Davis explained that the appraised value is based on <br />approximately $.50 per square foot for the property. The Glenn <br />family had a larger tract at one time and it was split off with <br />parcels going to the daughter and son. The family is united in <br />wanting to deed all of the right-of-way to the County in exchange <br />for a waiver of any future paving assessments. <br />33 <br />BOOK 9.0 PArc 534 <br />
