r- S E p 2 <br />110, _ <br />BOOK 90 PAUE613 <br />resulted in the original developer, Bertha Weissman, recording a <br />"Declaration of Intent to Dedicate Rights -of -Way" (see attachment <br />#4). However, the rights-of-way have not yet been legally <br />described, and the county has not yet officially accepted the <br />dedication. Furthermore, based upon the Board's pronouncements and <br />the mapping of Pine Lake Estates as a standard subdivision in the <br />Property Appraiser's tax parcel maps, some building permits were <br />issued in the 1980's to develop Pine Lake Estates parcels. <br />Staff Recommended Solutions <br />Based upon the unique, past treatment of Pine Lake Estates by the <br />County, it is staff's opinion that formal actions should be taken <br />to try to bring Pine Lake Estates up to a legal, developable <br />standard. Therefore, in staff's opinion, the following actions <br />should be taken: <br />1. Make parcels of record buildable. Although the "subdivision" <br />was illegally created without proper plat approval, past <br />county actions regarding parcel development, rezoning, and <br />rights-of-way issues form unique circumstances surrounding <br />Pine Lake Estates that warrant variance consideration. The <br />Board of County Commissioners should grant variances from <br />certain provisions of the subdivision ordinance to allow <br />development of Pine Lake Estates parcels that were of record <br />in January, 1983. [Note: On January 1, 1983, there were 72 <br />parcels of record in Pine Lake Estates. Presently, there are <br />still only 72 parcels of record.] <br />Cost: Normally, a subdivision variance request costs $500.00; <br />however, the Board of County Commissioners could waive such a <br />fee if it determines that the county should initiate the <br />variance action. <br />2. Establish county rights-of-way within Pine Lake Estates. The <br />Board of County Commissioners should authorize county forces <br />to survey road rights-of-way throughout Pine Lake Estates, as <br />shown on the Pine Lake Estates map and referenced in the <br />Declaration of Intent to Dedicate Right -of -Way executed by <br />Bertha Weissman on August 19, 1982 (see attachment #4). After <br />the surveying information is obtained and the rights-of-way <br />are legally described, the Board of County Commissioners <br />should approve a resolution accepting the Weissman right-of- <br />way dedication, and should authorize staff to record the <br />resolution in the public records. The county would accept the <br />rights-of-way but would not accept any maintenance <br />responsibility of the roads. <br />Cost: Surveying costs: $9,278.33 (see attachment #5). All <br />costs to be borne by the Pine Lake Estates property owners. <br />3. Allow improvement of roads and drainage by private property <br />owners. By accepting the road rights-of-way, the county would <br />control activities and development affecting its rights-of- <br />way. Although the county would have no responsibility or <br />obligation to improve or maintain the rights-of-way, it could <br />permit private property owners to perform individual or <br />concerted improvements and maintenance within the rights-of- <br />way. Permission for such activities would be granted via the <br />issuance of county right-of-way permits. <br />Note: Staff's proposal will not immediately solver any <br />Physical road or drainage problems in Pine Lake Estates. <br />However, if staff's recommendation is implemented, then in the <br />18 <br />
