Director Pinto acknowledged that the line had to be relocated <br />but he did not feel it should have resulted in destruction of the <br />road. He stated that it is unfair to compare 35th Avenue to older <br />roads in the area that were in worse condition before the <br />contractors started their projects. <br />Further discussion ensued, and Chairman Bird asked what was <br />needed to resolve this situation. <br />Director Pinto responded that staff from the Utilities and <br />Public Works Departments will have to negotiate with the <br />contractor. <br />Commission Tippin wanted to find a solution that is fair to <br />everyone. He stressed that the residents have a responsibility to <br />properly maintain their property. For instance, if a contractor <br />lays new sod and the residents do not water it at least every other <br />day, the sod will die. <br />Commissioner Eggert asked whether our contracts place enough <br />emphasis on careful workmanship. <br />Director Pinto explained that our standard form of contract <br />states that the project area will be returned to the condition it <br />was in prior to the start of the project. The County must protect <br />the interests of the residents and at the same time keep the <br />project costs reasonable. He agreed that the residents have a <br />responsibility to give their lawns at least as much maintenance as <br />they would under normal circumstances. <br />Commissioner Adams wanted to move quickly to resolve these <br />problems. <br />Director Pinto clarified that no more payments will be made <br />until the majority of these items are resolved. He stressed that <br />he was depending on Public Works Department staff to let him know <br />when the road is restored to its previous condition. The <br />consulting engineer will also determine whether or not the damage <br />was avoidable. <br />Bob Moore, 510 33rd Avenue, stressed that drainage problems <br />continue to exist on 33rd Avenue because of dirt that was dumped in <br />the swales. There is no drainage from south to north and he has <br />standing water in his driveway that was not there before the <br />utility lines were installed. The east side of the intersection of <br />33rd Avenue and 4th Street has been badly damaged. He offered to <br />show Mr. Bates the problem areas. <br />Mr. Bates argued that his workers did not fill the swales with <br />dirt, nor did they cover the dirt with sod.
