n <br />OCT 1 1993 BOOK 90 PAGE 79 <br />A.O.B., the road has not been returned to its previous condition <br />and staff is withholding about $3,000 plus $20,000 retainage. It <br />is the opinion of Road and Bridge Department staff that the <br />contractor damaged the pavement and should be held responsible for <br />repairing it, which Director Pinto estimated will cost about <br />$5,000. <br />Administrator Chandler advised that 35th Avenue was paved <br />about 2 years ago, so it is a relatively new road. <br />Commissioner Macht mentioned that he drove by 35th Avenue <br />about 2 weeks ago and it looked like a dog's dinner. <br />Commissioner Adams noticed quite a few unresolved items on the <br />engineering inspector's checklist. She stated that she inspected <br />the subject area this morning and noticed some problems on 33rd <br />Avenue in addition to the problems on 35th Avenue. For example, at <br />one house the dirt was not removed from the culvert where it had <br />been dumped to make a temporary driveway. Water has backed up and <br />mosquito larvae are swimming around. Commissioner Adams <br />acknowledged that many of the problems have been corrected. <br />However, the County has a responsibility to make sure neighborhoods <br />are returned to their original condition or better after projects <br />are completed. <br />Director Pinto confirmed that the final payment and release of <br />retainage will be presented to the Board for approval after staff <br />makes the determination that the problems have been resolved. <br />O'Neal Bates, president of A.O.B., contended that the total <br />amount being withheld is actually about $50,000 because the units <br />on the job exceeded the amount that was bid. He stated that his <br />understanding was that all of the problems were resolved with the <br />exception of damage to the pavement on 35th Avenue. He regretted <br />that he was not invited to the meeting when the residents <br />registered their complaints. Mr. Bates maintained that although <br />the roadway damage is there, it is no worse than damage done by <br />other contractors on similar projects. He did not think the damage <br />was sufficient to warrant recapping the entire road, and he <br />stressed that his company was not accepting responsibility for <br />repairing it. He pointed out that after the contract was bid, the <br />pipeline had to be moved closer to the road which resulted in <br />breakage on the edge of the road. He was not aware of any problems <br />on 33rd Avenue, but indicated he would be glad to inspect the area <br />in question. He emphasized that he wants to get the job finished <br />to everyone's satisfaction because he would like to work with the <br />County on other projects. <br />16 <br />
