- M M <br />The agreement is for 20 years, and it can be terminated by the FGFWFC, but <br />not by the county unless approved by the Commission. <br />ALTERNATIVES AND ANALYSIS <br />The alternative are as follows: <br />Alternative No. 1 <br />Approve the Agreement and authorize the Chairman's signature. <br />Alternative No. 2 <br />Deny approval of the Agreement. <br />RECOI4NDATIONS AND FUNDING <br />Staff recommends Alternative No. 1 whereby approval is given for signature <br />by the Chairman of the Board. <br />Commissioner Eggert felt that the agreement was one-sided <br />because the Florida Game and Fresh Water Fish Commission <br />(FGFWFC) can cancel at any time, but the County cannot cancel <br />the agreement for 20 years. <br />Chairman Bird explained that the FGFWFC does want not to <br />invest funds if the County has the ability to cancel the <br />agreement. <br />Public Works Director Jim Davis reported that the FGFWFC <br />has been building boat ramps for freshwater fishing areas in <br />the state for a number of years and is very responsible about <br />maintaining the ramps. He stressed that he has always had a <br />good working relationship with the FGFWFC, and that much of <br />the language in the contract is mandated by the Federal <br />government. <br />Commissioner Adams felt that 20 years is an excessive <br />amount of time for the County to be locked into an agreement. <br />She was concerned that the State may not have adequate funds <br />in the future to properly maintain the boat ramp, and wanted <br />the County to be able to take over if that happens. <br />Attorney Vitunac advised that it may be possible to amend <br />the agreement. However, if the County cancels the agreement, <br />the FGFWFC will probably want to be reimbursed for all monies <br />invested in the ramp. <br />Administrator Chandler agreed with Attorney Vitunac, but <br />he pointed out that there is not a large amount of money <br />involved. <br />After further discussion, Chairman Bird directed the <br />County Attorney to determine whether the FGFWFC would be <br />willing to add a termination clause to the agreement and then <br />present it to the Board for approval. <br />49 <br />BOOK 9® FACER% <br />NOV - 91993' <br />
