Fr- DEC - 7 1993 50g 91 FA F lu -1 <br />utilities, the County assumed various developer agreements in effect <br />at the time of the purchase. One of these agreements was with <br />Gordon S. Nutt for various water and wastewater capacity <br />reservations-. <br />ANALYSIS: <br />At the time of the assumption of the Gordon S.- Nutt developer <br />agreement, it was acknowledged that certain inconsistencies in the <br />agreement existed as to the number of units reserved and the <br />capacity related to each unit. Under the original developer <br />agreements, the County could have been committed to provide 208,000 <br />gallons per day of wastewater capacity and 182,000 gallons per day <br />of water capacity. As a result of the inconsistencies in the <br />agreement, the Department has held various meetings with the <br />developer in an attempt to resolve the issues. As a result of these <br />meetings, the Department and Mr. Nutt have negotiated the attached <br />letter agreement to resolve the issues. Under the negotiated <br />agreement, the maximum capacity requirement is for 131,250 gallons <br />per day of wastewater capacity and 131,250 gallons per day of water <br />capacity. <br />RECOMMENDATION: <br />The staff of the Department of Utility Services recommends the <br />approval of the attached letter agreement to resolve the issues in <br />the original developer agreements. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously approved <br />the letter agreement to resolve the issues in the <br />original developer agreements. <br />SAID LETTER IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />G.
