DEC o 71993 <br />BOOK 91 FAGE 124 -7 <br />really does not speak to that situation or to whether or not living <br />aboard should be allowed only in commercial marinas. <br />Director Keating explained that our ordinance is specific in <br />the sense that if there is going to be occupancy for more than 7 <br />days, it has to be in a commercial marina that is approved for <br />living aboard. The question is whether someone can circumvent the <br />ordinance by staying 5 days and then moving for 2 and back for 5. <br />That is an issue that is difficult to deal with, but we are going <br />to deal with that through the Code Enforcement Board and issue an <br />order and have some presumptions in that order. In this particular <br />case, the boat can be moored there longer than 7 days as long as it <br />is not a live -aboard situation. <br />Commissioner Adams felt it is obvious that we have to address <br />the stop and start situation by changing our ordinance to give it <br />more teeth. <br />Mr. Laughlin reiterated that the Code states very clearly that <br />living aboard for more than 7 days is in violation. This couple <br />have been aboard the boat for three continuous weeks. They eat, <br />they watch TV after 9 p.m., so they must be dumping sewage into the <br />river. The residents have seen the couple sneak aboard the boat <br />the last couple of nights. <br />Mr. DeBlois reported that the occupants have said that they <br />are staying in a house nearby and that the lights and the TV in the <br />boat were left on for security reasons. Therefore,, both sides have <br />to be heard and the legal process followed. <br />Discussion followed about rewriting our ordinance to restrict <br />someone from renting a boat slip in a residential area without <br />renting a residence. <br />Chairman Bird advised Mr. Laughlin that the Code Enforcement <br />process will be followed and that staff will address the stop and <br />start live -aboard situation in our ordinances. <br />Mr. Laughlin thanked the Board for allowing him the <br />opportunity to speak this morning. <br />COMPREHENSIVE PLAN AMENDMENTS <br />The Board reviewed the following memo dated 12/1/93: <br />22 <br />
