Keating, AICP AMM <br />Community Development Director <br />DATE: December 1, 1993 <br />SUBJECT: COMPREHENSIVE PLAN AMENDMENTS <br />It is requested that the information herein presented be given <br />formal consideration by the Board of County Commissioners at their <br />regular meeting of December 7, 1993. <br />DESCRIPTION & CONDITIONS: <br />Following this item are four comprehensive plan amendment reests. <br />These requests were submitted during the month of July, con istent <br />with the County's twice a year window for amendment submittal. The <br />proposed amendments are now being presented to the Board for <br />transmittal consideration. As in the past, the Board must <br />determine whether or not to transmit the amendment requestw to the <br />Department of Community Affairs (DCA) for their review. Amendments <br />not approved for transmittal are deemed to be denied. <br />Since June of 1993 when the Board last considered plan amendments <br />for transmittal to DCA, the applicable statute regulating the <br />amendment of local comprehensive plans has changed. These Changes <br />were approved by the legislature in its 1993 session as part of the <br />ELMS (Environmental Land Management Study) bill. <br />With respect to the transmittal of proposed plan amendments o DCA, <br />the principal change has been to provide local governments with the <br />opportunity to have minor amendments or amendments with few impacts <br />considered in a shorter time period. As provided by the ELMS <br />changes, a local government, as part of its transmittal, may direct <br />DCA not to initiate a full review of a proposed plan amendment. <br />This can speed up the process for some amendment requests, but <br />lengthen the process for other proposed amendments. <br />Attached to this report is a set of flow charts. These illustrate <br />the old procedure for the review of plan amendments as well as the <br />new review options. <br />Under the old amendment review procedure, DCA had ninety ays to <br />review a plan amendment request (this included obtainin other <br />agencies' review comments) and send its ORC -(Obje tions, <br />recommendations, comments) report back to the County.) The <br />legislature reduced this ninety day review time to sixty days. <br />This is illustrated in the attached "review requested" flow chart. <br />The sixty day timeframe applies if the County opts to have DCA <br />review proposed amendments in generally the same manner as has been <br />done in the past. <br />If, however, the County feels that a proposed amendment has <br />insignificant impacts and is generally non -controversial, the <br />County may direct DCA not to review the proposed amendment.
