RIGHT-OF-WAY ACQUISITION - I.R. BLVD, PHASE IV - VIRGINIA WALKER <br />RUSSELL PARCEL <br />The Board reviewed the following memo dated 11/1/93: <br />TO: James E. Finney, SRA � <br />County Right -of -Way Agent <br />SUBJECT: Purchase Authorization; 41st Street Right -of - <br />Way Acquisition, Virginia Walker Russell <br />Parcel, Indian River Boulevard, Phase IV <br />DATE: November 1, 1993 FILE: russell.agn <br />DESCRIPTION AND CONDITIONS <br />Indian River County is planning to widen and pave 41st Street east <br />of US Highway #1 to Indian River Boulevard, Phase IV. Additional <br />right-of-way is needed to accomplish the project. The right-of-way <br />parcels are located on the north side of 41st Street. The owner <br />has agreed to sell and has executed the Contract For Sale And <br />Purchase at $41,750 with an Addendum for additional trees outside <br />the right of way for $3,100; and, Attorney Fee $1,150 which <br />includes a $250 title search fee. <br />The right-of-way was appraised at $37,800 as of March 8, 1993. <br />RECOMMENDATIONS AND FUNDING <br />Staff requests the Board accept the contract (total price of <br />$46,000) and direct the Chairman to execute the contract on the <br />Board's behalf. <br />Funding is available in Account No. 309-215-541-066.12. <br />Commissioner Adams had some real problems with the terms of <br />this acquisition proposal. <br />Public Works Director Jim Davis referred to Item #5 in <br />Addendum I to the purchase contract which deals with the naming of <br />the road. He explained that Chapter 951 of the County's Land <br />Development Regulations deals with the road addressing system and <br />the property owner is requesting that language be adhered to in the <br />future for the naming of the road. There is a concern that if the <br />road is named some other name than 41st Street, it may not be <br />agreeable to some of the people who own property along the road. <br />The County Attorney's office feel the owner has the right to put <br />this language in the contract, but it is not standard language that <br />we would like to see in our right-of-way purchase contracts because <br />90 <br />DEC - 71993 BOOK 91 PAr,E 193 <br />
