DEC - 7 1993 <br />BOOK 91 PAGE 194 <br />we really don't know what our road naming system may be in the <br />future. There might be some good reason to change it, such as when <br />the 911 system was established. Director Davis wished to see Item <br />#5 and Item #6, which is a reversion clause, stricken from the <br />Addendum. However, the trustee for the property indicated he might <br />not approve the contract if those items were taken out. Director <br />Davis explained that draining the natural slough on 41st Street <br />will raise the cost from $37,800 to $41,750. <br />Commissioner Adams didn't like Item #9 either. She disliked <br />the attitude expressed in the letter and felt we should ask <br />ourselves just how bad we need this right-of-way. She understood <br />we already have the 45th Street right-of-way. <br />Director Davis advised that two more right-of-way acquisitions <br />are being brought before the Board next week. This is the 41st <br />Street link between Indian River Boulevard and U.S. #1. We have <br />purchased 45th Street right-of-way already, so we definitely will <br />have the 45th Street connection plus 37th Street and 53rd Street. <br />Those are 1 -mile spacings. There is a drainage problem west of <br />U.S. #1 due to a natural slough between the ridge and the railroad <br />tracks. To drain that slough requires the securing of easements <br />and rights-of-way east on South Gifford Road to the river. <br />Commissioner Adams had a problem with it because she did not <br />like to be bullied and was offended by the attitude expressed in <br />the letter. She didn't think it would be right to pay this amount. <br />Chairman Bird asked if she would feel right about it if we <br />offered them just our appraised value, but Director Davis <br />interjected that he felt the value of the cost per acre is a good <br />price in the current market. There is a need for the right-of-way, <br />but he couldn't say whether it is a critical need. It would <br />provide a link at 41st St. between the Boulevard and U.S. #1 and it <br />would solve the drainage problem in that area. <br />Commissioner Macht pointed out that this property is being <br />greatly enhanced by the position of these rights -of -ways and by the <br />position of the Boulevard. <br />Commissioner Adams'understood that the appraisal we had done <br />came out at $37,800. <br />Director Davis further advised that in the records of St. <br />Lucie County we found a 1918 title to a 45 -ft. width of right-of- <br />way on 41st Street, but the property owners have been claiming that <br />they have been paying taxes on that land because the Property <br />Appraiser's Office did not pick up on that 1918 title. They are <br />asking us to pay back taxes plus a 6% economical adjustment, which <br />is the value of their money back into history at 6% plus the costs. <br />they have incurred in maintaining the road. <br />91 <br />
