ANALYSIS: _. <br />All Indian River County Department of Utility Services requirements <br />have been met, except the following: <br />1. Sod restoration along 42nd Court in Westwind Subdivision; <br />contractor personnel assured us that the sod was to be put <br />down on Friday, December 10. <br />2. Regrading swale from north property line of 475 31st <br />Avenue to south property line of 535 31st Avenue. Remove <br />spoil pile from swale area. <br />3. Remove excess fill, and regrade swale where temporary <br />driveway was installed and removed at 510 33rd Avenue. <br />4. Overlay driveway swale at 430 38th Avenue to provide <br />runoff. <br />5. Clean up and remove all excess materials and equipment <br />from the temporary project storage yard. <br />The contractor has planned, through coordination with our <br />consultant, McQueen and Associates, to correct these items by the <br />weekend, December 11 and 12. <br />Restoration has been accepted by the Public Works Department, except <br />for the requirement above and for removal of one piece of equipment <br />which apparently belongs to the contractor. <br />Final clearance has been received from the Department of <br />Environmental Protection. <br />RECOMMENDATION: <br />The staff of the Department of Utility Services recommends approval <br />of Change Order No. 1 and approval of the final pay request in the <br />amount of $52,612.65 as payment in full. <br />Utility Services Director Terry Pinto reported that Public <br />Works Department staff made a final inspection, and the problems <br />apparently have been resolved. <br />Commissioner Macht contended that 3 or 4 of the people who <br />live in that area continue to complain that the swales have not <br />been returned to their previous condition, and there are cracks in <br />some of the driveways which the residents claim were caused by the <br />contractor. Commissioner Macht saw spots where hydraulic fluid <br />leaked or was dumped and one area where the machinery left tracks <br />on somebody's property. The residents told him they were never <br />included in any of the inspections, and it was their feeling that <br />they should be included in the final acceptance process. <br />Commissioner Adams stressed that she did not want to release <br />the final payment until all the problems are resolved. She was <br />willing to accompany staff to the area and explain what she was <br />talking about. She emphasized that we have a responsibility to <br />33 <br />BOOK, 91 PAGE 252 <br />
